Rialto Adjudications does not charge an application fee, nor any fee, for an Adjudication Certificate should one be requested.

Adjudicator’s Fees

Details of the method of costing the adjudication services and arrangements are as follows:

Major Adjudications (Claims Exceeding $100,000.00 (incl GST))

1. 1. 1. The adjudicator’s fees would be calculated as follows:
         • Hourly rate between $275.00 and $484.00 per hour (incl GST) depending on the seniority of the adjudicator nominated.
      2. There would be no additional fee for usual para-legal services, secretarial services, electronic database creation, imaging, photocopying or facsimile charges. In the event that substantial additional para-legal services, secretarial services, electronic database creation, imaging, photocopying or facsimiles became necessary, additional fees would be charged only with the parties’ prior agreement.

1. Lesser Value Adjudication Claims (Claims/Disputes less than $100,000.00 (incl GST))The adjudicator will advise the capped fee, generally in accordance with the following scale:

   If a payment schedule provides a negative scheduled amount that the adjudicator is required to deal with in the Determination, that amount may be taken into account in calculating if the Application falls under one of the Lesser Adjudication Claims capped fees.

2. Adjudicator’s fees are paid directly by the parties to the adjudicator.
3. Rialto Adjudications does not charge the claimant for an Adjudication Certificate.
4. Rialto Adjudications has a fee sharing arrangement with adjudicators, the adjudicator pays Rialto Adjudications a fee of 15% of the fee that the adjudicator charges to the parties. This is not an additional fee.
5. The services that Rialto Adjudications provides to the adjudicator include:
   • Promoting the Act to the building and construction industry
   • Providing information to the public about the Act and the adjudication process
   • Receiving adjudication applications
   • Nominating adjudicators
   • Providing administrative support to adjudicators when requested
   • Proof reading adjudication determinations when requested
   • Releasing adjudication determinations to the parties
   • Providing copies of adjudication determinations to the regulator
   • Reporting adjudication data to the regulator
6. In the event that the 15% fee payable from the adjudicator to Rialto Adjudications exceeds $11,000.00 (incl GST), the fee will be capped at $11,000.00 (incl GST).
